Whereas the GO Paperless!™ Publishing Service and Paperless Paper™ was built upon the principles of responsible use of our earth’s natural resources and on the importance of the respecting the privacy, information and choices of consumers.

AND Whereas these principles inform the rules and obligations that constitute the Fair Use of the Service as described in this Charter.

All Users of the GO Paperless!™ Publishing Service ( the “Service”) are bound by this Charter. By using the Service, You acknowledge that You have read, understood, and agree to be bound by the GO Paperless!™ Charter of Fair Use and agree that GO Paperless!™ Corporation (“GO Paperless!™ ”) will make the sole determination whether this Charter has been violated. This Charter may be amended by GO Paperless!™ at any time without notice, by posting the changes in this location. Such new terms and policies shall become effective immediately upon such posting for all Users. It is the User’s obligation to check this page regularly for updates to this Charter.

Part II: Meanings

2.0 In this Charter_

"Commercial User” means an individual, organization, company, or group of individuals who

  1. lease a keyword,

  2. advertise on Paperless Paper™ ,

  3. provide content for publishing through GO Paperless!™, or

  4. otherwise use the Service to make content available to End Users;

“content” means all forms of communications including, without limitation, text, graphics (including photographs, illustrations, images, drawings, logos), executable programs, video recordings, and audio recording;

“End-User” means an individual using the system to request a Paperless Push or a Paperless Pull for personal or commercial purposes;

“GO Paperless!™ ” means GO Paperless!™ Corporation;

“keyword” means the word, number or combination thereof, which identifies the content the End-User is requesting and must be included in the body of a text message request for Paperless Paper™;

“Paperless Paper™” is the digital equivalent to paper and is represented by the Eco-Hero Character;

“Paperless Pull” means to request that Paperless Paper™ be sent to your own email address;

“Paperless Push” means to request that Paperless Paper™ be sent someone else’s email address with consent;

“Partners of GO Paperless!™ ” means aggregators, operators, suppliers, resellers, partners agents or affiliates of GO Paperless!™ Corporation;

“Publishing Mark” means the official GO Paperless!™ Publishing Mark that indicates content available for request through the Service;

“Publish” means to make content available for request through GO Paperless!™;

“Request” means to send a text message to the GO Paperless! Publishing Service to initiate an email response containing third party content;

“ the Service” and “ the GO Paperless!™ Publishing Service” mean to make content available to be accessed through text messaging and email;

“short code number” means the text messaging number where all requests for Paperless Paper™ must directed. GO Paperless!™ current short code number is 51051 in Canada and the United States; and “User” means an End User, Commercial User and Partners of GO Paperless!™.

 

Part III: Fair Publishing

3.0 Published Content

a) Commercial Users shall not use the Service to publish any of the following content:

  1. content that violates the privacy rights or intellectual property rights of others;

  2. obscene, profane, pornographic content;

  3. content that promotes or incite hatred; or

  4. content that is otherwise offensive or objectionable.

b) All content submitted for publishing on the Service must comply with

  1. all applicable privacy, advertising, marketing laws including but not limited to CAN-SPAM Act of 2003;

  2. the applicable mobile marketing rules and guidelines set-out by the Canadian Wireless Telecommunications Association (CWTA) the Mobile Marketing Association (MMA);

  3. the No Green-Washing Policy of this Charter; and

  4. any additional applicable federal, provincial, state and locals laws, rules and regulations

c) GO Paperless!™ and Partners or GO Paperless!™ reserves the right to move, remove or refuse to publish any content, in whole or in part, that it, in its sole discretion, decide are unacceptable, undesirable or in violation of this Charter.

3.1 No Green-washing Policy

The GO Paperless!™ recognizes the threat that Green-washing poses on the environment and has developed this policy to help to keep the market free of Green-washing. False or misleading environmental marketing claims confuse the marketplace and undermine the efforts of those business and industries that are making legitimate efforts to lessen their impact on the environment.

This type of advertising slows the progress and uptake of innovation that will ultimately lead to real solutions to combat the environmental crises. GO Paperless!™ strictly prohibits the use of the Service to promote such content, and reserves the right to refuse to publish any content deemed to be inappropriate by GO Paperless!™ at its sole discretion for any reason whatsoever. What constitutes green-washing is to be decided solely by GO Paperless!™. Users may refer to the following 6 indicators to determine if their content may be Green-washing:

3.2 Indicators of Green-washing

  1. A claim that promotes one environmental benefit while hiding another negative impact of the same product or service.

  2. A claim that is meaningless in that it is too vague to provide the public with enough information to determine the legitimacy or benefit of the claim

  3. A claim that promotes an environmental practice or benefit where the promoted practice or benefit is an industry standard or a legal requirement.

  4. A claim that promotes the environmental benefits of a product or service that is inherently destructive to the environment

  5. A claim that promotes an environmental benefit of a product or service without providing reasonable proof of the claim

  6. A claim that is false, misleading or otherwise deceptive

3.4 Publishing Mark

Use of the Publishing Mark depicted here and other intellectual property belonging to GO Paperless!™ is restricted to users who have a licence with GO Paperless!™ conferring limited to rights to the use of the mark as per an express customer agreement or other written agreement. All rights in the Publishing Mark remains the property of GO Paperless!™ at all times.

3.5 Publishing Mark in Print and Digital Media

a) The Publishing Mark allows End-Users to know that they are requesting Paperless Paper™ from a trusted source. Each time a keyword is advertised in print or digital media the Publishing Mark must always be depicted in the advertisement and must be depicted according to the following requirements.

The Publishing Mark must:

  1. be clearly legible

  2. be an approved graphic as provided by GO Paperless!™

  3. appear at least as large as the short code number in the advertisement

  4. be placed beside the short code number, and

  5. be used under the authority of, and accordance with an express written license from GO Paperless!™

b) If a keyword is advertised in a medium that does not support the use of graphics, the Publishing Mark must appear in the advertisement beside the short code number like so, 51051|GO|, where 51051 is the short code number.

3.6 Publishing Mark Limitations

All permissions to use the Publishing Mark are granted only for the duration of a Commercial Users’ keyword lease, and in accordance with an express agreement. In the use of the Publishing Mark, permission holder’s must always comply with this Charter including but not limited to the No-Greenwashing Policy. Suspected misuse of the Publishing Mark will result in automatic banning.

3.7 Ownership of Intellectual Property

GO Paperless!™ owns all rights, titles and interests in GO Paperless!™ 's intellectual property, including but not limited to: trade-marks, service marks, trade-names, inventions, copyrights, trade secrets, patents and know-how relating to the design, function or operation of plans and of the hardware and software systems and resources necessary to provide the individual service elements of which they consist. This Charter does not constitute a license any User to use GO Paperless!™ ’s trademarks or trade-names. All instances of infringement will be taken seriously and responded to accordingly.

Part IV: Fair Service & Privacy

4.0 Collection and Use of Personal Information

The Service limits the collection, storage and use of personal information to the minimum that is required to provide high quality of service to all Users. GO Paperless!™ uses the information collected to fulfill requests for GO Paperless!™ products and services, improve our services, contact the End Users, conduct research and provide anonymous aggregated reporting to Commercial Users and Partners of GO Paperless!™ .

4.1 Each Request

Each time a request is made for Paperless Paper™, GO Paperless!™ automatically collects and records the following information about the transaction, the phone number of the mobile phone where the request was initiated, the email address provided for delivery and the content that was requested (the keyword that was accessed).

4.2 First-time Requests

The first time a request is made from a specific mobile phone number, the End User is asked to provide an email address. This email address is stored with GO Paperless!™ along with the mobile telephone number where the request was initiated. The email address becomes associated with that particular mobile phone. This ensures that future requests made from the same mobile phone will be delivered to the email address that was given, except when the request specifies a different address for delivery. 4.3 Paperless Push

When a request is made to deliver Paperless Paper™ to an email address that does not match with the mobile phone that requested it, the Paperless Paper™ will be delivered to the new email address and will be cc’ed (carbon copied) to the email address associated with the requesting mobile phone. This ensures complete disclosure to both the requesting and receiving party.

4.4 Links and Replying to Emails through Paperless Paper™

The Service allows Commercial Users to connect with End Users in a sustainable way. Once we have made the introductions End Users and Commercial Users are free to pursue a sustainable relationship together. As a part of the Service, End Users can link to a Commercial User’s website and online content from the Paperless Paper™. End users can also engage directly with the customer by using the reply function in the email portion of the Paperless Paper™. By using the reply function in the email End-Users are initiating contact with the Commercial User directly and outside the GO Paperless!™ Service. As with any internet links, once you link from your Paperless Paper™ to the world wide web, End-Users have left the limits of GO Paperless!™ and should consult the privacy policies of the websites they visit.

4.5 Opt-Out

End Users who do not wish to have their email address and mobile phone number stored, may elect to opt-out either by sending a text message to 51051 or other GO Paperless!™ short codes with the message body “optout” or “stop” or by using the sending an email request to opt-out@gopaperless.ca . End Users who have elected to opt-out will be treated as a first time End User the next time they use the Service.

4.6 Notice

GO Paperless!™ will communicate with you using the same email address in that is used to deliver your Paperless Paper™ , including, at times to notify you of changes to our policies, products and services.

Part V: Fair Conduct

5.0 Updating your Email Address

End Users are responsible for keeping their email address current with GO Paperless!™. Email addresses may be updated by sending a text message to the number 51051. Text the word UPDATE and your new email address to the number 51051. Communications from GO Paperless!™ and delivery of your Paperless Paper™ will be made to the new email address provided.

5.1 Consent for Paperless Push

The Paperless Push was designed to facilitate a paperless exchange of information in pre-existing commercial relationships. End Users shall not use the Paperless Push to send unsolicited commercial electronic mail to people without their consent, as this constitutes a use of the system to send SPAM.

5.2 No Waste Policy

To achieve a sustainable marketplace, we must make an enemy of waste. By offering Paperless Paper™ as an alternative to paper for sharing and disseminating information, the Service was designed to minimize the waste of both natural and economic resources. In an effort to encourage responsible consumption and to protect all Users, End Users who request 10 dollars or more in copies of the same Paperless Paper™ to be delivered to the same email address will be flagged for banning and may be banned entirely from Service at the sole discretion of GO Paperless!™ .

5.3 General Conduct

a) Users shall not use the Service to:

  1. violate the copyrights or intellectual property rights of others. You assume all risks regarding the determination of whether material is in the public domain;

  2. invade another person's privacy or collect or store personal data about other Users;

  3. distribute mass or unsolicited e-mail or otherwise violate the Anti-SPAM policy of this Charter;

  4. distribute content containing a virus, lock, key, bomb, worm, Trojan horse or other harmful, limiting, destructive or debilitating feature v) interfere with the Service so as to “hack”, “crash” or overload the Service

  5. generate levels of traffic sufficient to intentionally impede other’s ability to request Paperless Paper™ ;

  6. manipulate identifiers in order to disguise the origin of any content transmitted through the Services;

  7. participate in illegal soliciting or gaming;

  8. promote or incite hatred; or

  9. attempt to use the Service in such a manner so as to avoid incurring charges for usage

b) All use of the Service must comply with

  1. all applicable privacy, advertising, marketing laws including but not limited to CAN-SPAM Act of 2003;

  2. the applicable mobile marketing rules and guidelines set-out by the Canadian Wireless Telecommunications Association (CWTA) the Mobile Marketing Association (MMA);

  3. all Policies and Terms of this Charter; and

  4. any additional applicable federal, provincial, state and locals laws, rules and regulations

c) GO Paperless!™ and Partners or GO Paperless!™ reserves the right to suspend, terminate Service or ban Users at its sole discretion, for any reason whatsoever.

Part VI: Anti-SPAM Policy

6.0 Anti-SPAM Statement

An important part of Paperless Marketing practice is the use of permission-based marketing models. The Service is based on a single request model, other than legal notices and information regarding the use of the Service, End Users will receive only the information that is requested. End User will not receive unsolicited text messages or unsolicited email messages from GO Paperless!™ or on account of using the Service.

6.1 Spamming Prohibition

Users shall not use the Service, or any information obtained through the use of the Service, to violate or, knowingly or otherwise, permit the violation any provision of the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM ACT) or to send unsolicited email, of any kind whatsoever to GO Paperless!™ End Users.

6.2 Application of this Part

In order to protect against abuse, All Users, and partners of GO Paperless!™ must comply with this Anti-SPAM Policy.

6.3 Enforcement

This Anti-SPAM policy is strictly enforced and any who are caught misusing the system will acted upon and reported to the authorities where deemed necessary by law. GO Paperless!™ . monitors the transactions on the system and will take appropriate action if misuse is suspected including suspension or termination of service and/or banning of mobile phones from the system.

Part VII: Violations

7.0 Violation of this Charter

GO Paperless!™ has the right, but not the obligation, to monitor or investigate any content that is transmitted using the Services. If the Services are used in a way that GO Paperless!™ , in its’ sole discretion, deems as violating this Charter, GO Paperless!™ and Partners of GO Paperless!™ may take any responsive actions they deem appropriate. Such actions may include without limitation, temporary or permanent removal of content, and/or the immediate suspension or termination of all or any portion of the Services. GO Paperless!™ and Partners of GO Paperless!™ will have no liability for any such responsive actions. The above described actions are not exclusive remedies and GO Paperless!™ , and Partners of GO Paperless!™ may take any other legal or technical action deemed appropriate. Upon termination of Service, GO Paperless!™ and Partners of GO Paperless!™ are authorized to delete any files, programs, data and e-mail messages associated with the user. The failure to enforce this Charter, for whatever reason, shall not be construed as a waiver of any right to do so at any time.

7.1 Suspected Violations

Please direct any complaints of violations of this Charter to abuse@gopaperless.ca or contact at 647-477-7979. Questions or complaints, concerning third party content should be addressed to the applicable Commercial User.
 

Part VII: Amendments

8.0 Changes to this Charter

This Charter may be amended by GO Paperless!™ at any time without notice, by posting the changes in this location. Such new terms and policies shall become effective immediately upon such posting for all Users. It is the User’s obligation to check this page regularly for updates to this Charter.
